Collection and use of medical records is essential to the practice of family law, however, it is also a great responsibility both legal and ethical. HIPAA and HITECH provide the proper procedure for procurement and use. Unfortunately, many lawyers are not aware of the importance of following the guidelines laid out in HIPAA and HITECH. These statutes have both civil and criminal implications and therefore have ethical duties for the lawyer seeking to obtain medical records. This CLE will teach the proper procedures to obtain medical information and how to avoid the potential minefield of ethical consequences involved.
