Breakout session 1 | Advanced GAL: Termination of parental rights: What's civil about the civil equivalent of the death penalty? (qualifies for 1.0 GAL hour)

An examination of the termination of parental rights process with emphasis on the constitutional issues of notice, due process, separation of powers and legislative control of the bar. 

This program will review:

• The examination of the goals of the Adoption and Safe Families Act (ASFA) and how well those goals are being met.
• The impact on the child of a termination.
• Tips on how to handle a TPR case and preserve matters for appeal.
• Understanding of the concept of "ambiguous loss" - a child's profound sense of loss and sadness that is not associated with a death of a loved one.
• A comparison of the constitutional requirement of "unfitness" and the factors required under the Missouri TPR Statute.
• Awareness of the legislative attempts to define the role of the guardian ad litem.
