Breakout session 5 | Civil procedure: Knowledge of the rules is power

Case study analysis of how to use the Rules of Civil Procedure to shape factual and legal issues for trial. Underlying case pitted solo attorney and small general contractor against a large resort developer and a national law firm with 800 attorneys. The small guys won the $6 million dollar war, but lost nearly every battle along the way because of opposing counsel's superior knowledge and effective use of the Rules. This program examines the inherent power of the Rules to dictate the course and conduct of litigation.
