The passing of Amendment 2 on November 6, 2018, created a whole new series of questions for employers as they navigate the interplay of Amendment 2 with federal and state employment laws. This presentation will provide an overview of Amendment 2 and then examine the treatment of medical marijuana - including safe harbors and suggestions on how to proceed – in the context of:

  • The Americans with Disabilities Act
  • Missouri Human Rights Act
  • Section 285.575 RSMo, At-Will Employment Doctrine
  • Section 287.120, Unemployment Compensation & Workers’ Compensation
