9:00 - 9:50 AM | Uniformed Services Employment and Reemployment Rights Act (USERRA)
This presentation will provide an overview of the Uniformed Services Employment and Reemployment Rights Act, or USERRA. In so doing, we will explore the basic protections and applicability of the law, as well as the requirements it sets for both employers and employees.

9:50 - 10:40 AM | Discharge Upgrades
The discharge upgrade presentation will explain the process by which veterans apply for an upgrade of their military discharge.  Effectively representing a veteran applying for a discharge requires knowledge of the military discharge process, military records, and the rules and regulations that govern how applications are made and decided.  The presentation will cover these topics and will address recent policy changes by the Department of Defense that impact how the boards decide discharge upgrade applications.  Finally, the presentation will offer advocacy tips that will improve the chances of prevailing in a discharge upgrade case. 

Key points include:

  • The ramifications of a negative military discharge are severe and can impact a veteran their entire life.
  • An advocate must understand the laws and regulations that apply to discharge upgrade cases and the evidence needed to succeed at discharge boards.
  • Significant policy changes have occurred in the last years that give many veterans a meaningful chance of succeeding in their discharge upgrade case.

Serving our country in the military can pose unique issues for service members in meeting their civil legal obligations, and other aspects of their personal lives.  This presentation will provide an overview of the protections available in state and federal law for military service members and veterans to assist them in balancing their personal obligations with their military service.

Missouri Veterans Commission


Scotty Allen is General Counsel for the Missouri Veterans Commission in Jefferson City. He also served in the Army and the Air Force on active duty, the reserves and national guard for 27 years. He is a graduate of Southwest Missouri State University and the Washington University School of Law.

Veterans Advocacy Project


Brent Filbert is the Director of Military Law at the Veteran Advocacy Project (VAP). From 2018 to 2021, Brent served as the Clinical Director at the Veterans Clinic at the University of Missouri School of Law, where he established the Veteran Clinic’s discharge upgrade program and oversaw all upgrade cases. In addition to teaching veterans and law and trial advocacy, Brent also represented veterans in VA disability compensation appeals, prepared and submitted amicus briefs in important veterans law cases, and put together an annual national symposium on veterans law issues. 
 
Prior to joining the Veterans Clinic, Brent spent 30 years as an attorney in the military and in private practice. He served as Appellate Defense Counsel and Judge for the Navy-Marine Corps Court of Criminal Appeals; he was a prosecutor and defense counsel in military criminal trials; and he worked as a Special Assistant U.S. Attorney in Philadelphia, Pennsylvania. Brent retired as a Navy Captain in 2018. In private practice, Brent served as litigation counsel for Hughes, Hubbard & Reed, and a partner at Shook, Hardy & Bacon, working as a litigation attorney on product liability and toxic tort cases. He is an undergrad alum of University of Missouri (with honors),and received his J.D. (with distinction) at University of Missouri – Kansas City. Brent is also a distinguished graduate of the Naval War College – College of Naval Command and Staff, and has an LL.M. in Trial Advocacy from Temple University School of Law.
