Form-based zoning
An alternative to comprehensive land regulation, form-based zoning elevates DESIGN and FORM over separation of land uses. Implemented with the goal of quality urban design and compact, pedestrian-oriented urban places, the question arises how might form-based zoning be implemented and enforced from a legal point of view. What are the legal issues implicated when implementing and enforcing form-based zoning, as opposed to conventional zoning? Does this focus on design and form present legal hurdles which override the purported benefits?

Andrew J. Bauman is an attorney with Kreitler Law Firm, LLC. Bauman earned his J.D. at the Saint Louis University School of Law with a Concentration in Urban Development, Land Use, and Environmental Law. Bauman is admitted to practice in Missouri and is a member of the Missouri Bar, the American Bar Association, and the ABA Section of Real Property, Trust and Estate Law.
Grant M. Gamm brings a strong background in finance and law to the Firm. A native of Missouri, Grant was born and raised in the scenic Lake of the Ozarks area. He earned his undergraduate degree in Finance from Missouri State University before pursuing a law degree at the Saint Louis University School of Law.
During his academic journey, Grant enriched his education with international experiences. He has been an exchange student and worked in both the Netherlands and Switzerland. During his time at SLU Law, Grant clerked for the Missouri Court of Appeals and served as an editor for the SLU Law Journal, publishing an article on Data Privacy and Artificial Intelligence.
In his free time, Grant enjoys spending time with family and friends, traveling to new destinations, and exploring the outdoors through hiking.
Julia (Julie) Patterson Forrester Rogers joined the faculty of the SMU Dedman School of Law in 1990 after working as a real estate attorney with the Dallas law firm of Thompson & Knight. Previously, she received her B.S.E.E. with highest honors in 1981 and her J.D. with high honors in 1985 from the University of Texas at Austin, where she was a member of the Texas Law Review, Chancellors, and Order of the Coif.
Professor Rogers teaches in the areas of Property, Real Estate Transactions, and Land Use. She writes and speaks on real estate finance, the residential mortgage market, predatory lending, and other topics in real property law. She was one of the first legal scholars to write about the problem of predatory lending in the subprime mortgage market, and she was awarded the John Minor Wisdom Award for Academic Excellence in 1995 for her first predatory lending article. She is co-author of a property law casebook, Property Law: Cases, Materials and Questions, with Edward E. Chase, Jr. and W. Keith Robinson. For advancing research and scholarship at SMU, she was recently selected as a recipient of the 2024-2025 Provost Faculty Research Fellowship.
Jane Sternecky is Legislative Counsel for the Uniform Law Commission, where she works on enactment of uniform laws in Real Property. She is currently a fellow with the American Bar Association's Real Property, Trust & Estate section.
Tony L. Van Trece is the founder and principal of Van Trece Law Firm, P.C. Tony has significant experience in real estate transactions and development and public incentive financing as a former Government Attorney. Tony has gained experience in many facets of real estate law including real estate contracts, lease agreements, the negotiation of construction and architectural contracts, development agreements and addressing zoning and title issues.
As a former Assistant City Attorney, Tony’s experience includes working with low-income housing tax credits (LIHTC), Housing Trust Fund, Central City Economic Development Sales Tax (CCED), and tax increment financing (TIF) matters. Tony has structured real estate development projects which utilized Community Development Block Grant (CDBG), and other public subsidies to finance the new construction and rehabilitation of affordable housing and mixed-use projects.
Tony also has experience in estate and succession planning matters as well as personal injury litigation.
