This presentation provides a high-level overview of the key employment law issues that practitioners practicing in other substantive legal areas should be aware of, including topics such as discrimination, retaliation, medical leave, and whistleblower protections. It also provides brief discussions of hot button topics and current trends that may affect practitioners' work in other areas.

  • For actionable claims to lie, most often the subject employee must have some protected characteristic or occupy some type of protected class.
  • Time periods within which certain types of employment claims can often be much shorter than limitations periods in other practice areas.
  • Due to changes in policy (i.e., marijuana legalization) and state and federal agency action (i.e., the FTC's stance on noncompete agreements) the protections afforded to (or not afforded to) workers can change rapidly.

This session will cover the most common wage and hour pitfalls, as well as the corresponding claims that result when employers fail to follow the rules.

  • Current enforcement priorities of the U.S. Department of Labor Wage and Hour Division

2:05-2:55 p.m. | NLRB maintains stranglehold on American workplaces... Where we are and where we are headed
Dean and Colin will discuss the current state of the National Labor Relations Board after four years of the Biden-Harris administration. Dean and Colin will then discuss where they expect the Board to head in the next four years in light of the administration change. After that, they provide key legal updates on protected concerted activity, non-compete agreements, and what sort of damages the NLRB pursues currently.

  • The current rules and law make things very hard on employers.
  • Employers need to pay attention over the next few years because things will change with the new administration.
  • In light of the changes to the law, employers need to train managers and review policies and procedures.
